Balancing Sovereignty and Globalization: Legal Issues in the India–EU Free Trade Agreement

The proposed India–European Union Free Trade Agreement (India–EU FTA) represents one of the most significant developments in contemporary international economic law. The agreement seeks to deepen trade, investment, and regulatory cooperation between India and the European Union while simultaneously raising concerns regarding national sovereignty, regulatory autonomy, and economic globalization. This paper examines the legal dimensions of the India–EU FTA by analysing the tension between sovereign policymaking and global trade liberalization. It explores issues such as tariff reduction, intellectual property rights, digital trade regulation, environmental and labour standards, investment protection, and dispute settlement mechanisms. The study comparatively evaluates the differing legal philosophies of India and the European Union, particularly regarding public welfare, market access, and sustainable development. Furthermore, the paper analyses how the FTA negotiations reflect broader transformations in international trade governance and the increasing influence of non-tariff measures in global commerce. The paper concludes that while the India–EU FTA offers significant economic opportunities, its success depends upon achieving a balance between economic integration and preservation of domestic policy space, thereby ensuring equitable and sustainable trade relations.
