“ROLE OF ARTIFICIAL INTELLIGENCE IN CRIMINAL JUSTICE SYSTEM: CRIME PREVENTION AND JUDICIAL DECISION-MAKING

This study uses a doctrinal approach to investigate artificial intelligence's (AI) position in the criminal justice system. It starts with a conceptual framework for artificial intelligence (AI) and then goes on to examine how AI is used in law enforcement, criminal investigations, prosecutions, and court operations, emphasizing how it can improve case management, efficiency, and accuracy. It also assesses the Indian legal framework pertaining to AI, including constitutional provisions, the right to privacy as interpreted in Justice K.S. Puttaswamy v. Union of India , pertinent provisions under the Bharatiya Sakshya Adhiniyam, 2023 (BSA) and Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), as well as recent and significant court rulings. In order to provide justice and to protect fundamental rights, it identifies ethical, procedural, and constitutional issues and makes recommendations for the appropriate and open integration of AI in the criminal justice system.
