DIGITAL ARREST: CHALLENGES AND LEGAL SAFEGUARDS IN INDIA

The past decade has seen a boost in the evolution of technology in the law enforcement which has ultimately led to various practices like digital surveillance, algorithmic profiling and online data tracking. This has now led to the rise in a new concept named Digital Arrest. Though there is no provision of digital arrest in our Criminal Code, still many people in India have faced this and they had to face social, economic and legal consequences of the same. Digital arrest basically means the ability of the state to monitor, restrict and detain individuals based on their digital activity without actual or physical custodial arrest. This paper explores the emerging concept of Digital Arrest in India. The research also critically examines the recent incidents of Digital Arrest in India and the legal framework related to it including the Fundamental Rights guaranteed under Article 19 and 21, Data protection Laws, Information Technology Act, 2000; Bhartiya Nyaya Sanhita 2023, Bhartiya Nyaya Suraksha Sanhita 2023.
Furthermore, the paper includes the challenges posed by the deepfakes, misinformation spread by the people, social media manipulation and AI generated content. It raises alarm as to how the content has led to various negative consequences.
Moreover, it has provided a balanced framework for digital law enforcement in India so that the menace can be reduced to minimum, and ensure ethical use of AI and surveillance tools.
